Arbitration Decisions

Article 8, Overtime

1. Article 8.5.F, Rockville: March, 2007 decision involving PTF's working over 11.5 hours and non-ODL carriers working over 10 hours.

2. Article 8.5.G, Rockville: August, 2006 decision involving an additional payment of 125% to a non-ODL carrier.

3. Article 16.1, Rockville: July, 2005, Letter of Warning issued for failure to immediately report an injury.

4. Pre-Arbitration, August 2009.  Non-ODL's paid an additional 250% for violation of Art. 8.5.G

The Right to Use LWOP for Pre-Approved Annual Leave When an Insufficient AL Balance Exists

1. May, 2002 decision involving the use of LWOP when an employee has an insufficient AL balance to cover an approved period of AL.

2. Pre-Arbitration decision concerning the use of LWOP when there is an insufficient AL balance. 

Holiday Scheduling

1. Pre-Arbitration: Two carriers receive monetary payments when management over-schedules on a holiday, August, 2008.

Creating Undertime Through Curtailment

1. Article 41.Section 1C4, Step A decision and supporting Step B and arbitrations decisions concerning the curtailment of mail in order to create undertime for the purpose of pivoting.

Abusive Behavior by Management

1. Supervisor in branch 3825 post office reassigned due to abusive behavior. 

Clock Rings Falsified

1. Hundreds of clock rings altered by management in Germantown.

TE Issues

1. TE awarded $4800 when management chooses to not work them as a form of discipline.

Step B Decisions

Article 8, Overtime

1. Article 8.5.G, Rockville: February 2, 2007 management agreed there was a violation but would not agree to an additional 175% for non-ODL.  Non-ODL paid an additional 175%.

2. Art. 8.5.G, Rockville: February 8, 2007 non-ODL carriers were worked on their NS day and available ODL carriers were not fully utilized.  Management agreed their was a violation but would not agree to the requested remedy.  Non-ODL paid an additional 175%

3. Article 8 5.G, Rockville: February 9, 2007 non-ODL carriers were worked on their NS day and available ODL carriers were not fully utilized.  Non-ODL paid an additional 175%

4. Art. 8.5.G, Rockville: February 9, 2007 non-ODL carriers were worked overtime off their assignments and available ODL carriers were not fully utilized.  Management agreed their was a violation but would not agree to the requested remedy.  Non-ODL paid an additional 175%

5. Art. 8.5.G, Rockville: February 12, 2007 non-ODL carriers were worked on their NS day and available ODL carriers were not fully utilized.  Management agreed their was a violation but would not agree to the requested remedy.  Non-ODL paid an additional 175%

8. Six (6) step B decisions for violation of Art. 8.5.G, April 2008.  Awarded an additional 150% to the non-ODL carriers.

9. An additional 200% paid to the non-ODL for violation of Art. 8.5.G, April, 2009.

10. Non-ODL compensated an additional 200% of their base hourly rate for violation of Art. 8.5.G, April 29, 2009, Potomac, MD.

11. Non-ODL paid an additional 200% for violation of Art. 8.5.G, May 6, 2009, Potomac.

12. Non-ODL paid an additional 200% for violation of Art. 8.5.G, May 11, 2009, Potomac.

13. Non-ODL paid an additional 200% for violation of Art. 8.5.G, May 13, 2009, Potomac.

Failure to Provide Union with Requested Information

1. Failure to provide information within 48 hours per a Step A settlement, November 2006, Gaithersburg.

Holiday Scheduling

1. Holiday scheduling: This decision involves the over scheduling of carriers on a designated holiday.

TE Assignment

1. ODL awarded monetary compensation for the transfer of TE's outside of their employing office on a more than occasional basis.

2. TE awarded monetary settlement for assignment outside his assigned office.

Union Time

1. Union time will be granted immediately.

 

Step A Decisions

Supervisor's Falsification of Clock Rings

1. Management's falsification of clock rings, Rockville, July, 2007: Management personnel who falsify clock rings will be removed.

Rural Carriers Assigned City Carrier Duties

1. Rural carriers in Gaithersburg were assigned city delivery duties.  This settlement, for over $10,000.00 followed several previous settlements in which the ODL was paid regular overtime.

Failure to Provide Union with Requested Information

1. Failure to provide information.

2. Requested information not provided within 24 hours, June 13, 2008.

3. $325 paid to charity chosen by union for failure to provide requested information within 24 hours, June 2008.

4. $350 payment to the charity of the union's choice for failing to provide requested information within 24 hours.

Article 8, Overtime

1. Art. 8.5.G, April 2008.  Non-ODL's paid an additional 175%.

2. Non-ODL paid an additional 200% for violation of Art. 8.5.G and the ODL paid at applicable overtime rate.  

3. Non-ODL awarded an additional 200% for working overtime off their assignment.

4. Non-ODL paid an additional 250% for working overtime off their assignment in violation of Art. 8.5.G.

5. Non-ODL carriers paid an additional 250% for violation of Art. 8.5.G.

Holiday Scheduling

1. Administrative leave paid to carrier forced to work designated holiday.

2. Carrier provided with 8 hours of administrative leave when TE's and PTF's were not maximized to work a holiday.

Requests for Sick Leave

1. A history of agreements and settlements regarding when a carrier may be required to provide medical documentation to support a request for sick leave.

2.  Carriers were being charged LWOP or AWOL instead of SL when calling in sick.   

Calling Back to Inform Management of the Inability to Complete Assignment in the Authorized Time

1. The call back procedures when a carrier is unable to complete their assignment in 8 hours or within the approved overtime period.

Told to Curtail Mail to Create Undertime on Own Assignment

2.  WA/ODL carrier was being forced to curtail mail on his assignment in order to create artificial undertime on his route for the purpose of carrying pivots.     

 

Other Decisions

1. Clarification from USPS Labor Relations concerning the submission of FMLA requests.

2. Directive from Potter concerning compliance with arbitration awards.

3. Art. 8.5.G, Fredericksburg, VA, January 4, 2008.

4. Letter from USPS Labor Relations stating that handbook EL-814 is not a manual within the meaning of Art. 19.

5. This Step B decision concerns management's requirement that carriers process undelivered mail, carrier mark-up, while on the street.  This was filed by branch 142 in Friendship station, Washington, D.C..

6. Arbitration decision from Connecticut concerning the failure to comply with Step B decisions.

7. Arbitration decision from Branch 142 concerning Minor Route Adjustments.

8. Step B decision from Hartford, CT concerning the curtailment of mail in order to create undertime.

9. Arbitration award from Salt Lake City, UT.  Article 8 violation when non-ODL carriers were worked off-assignment overtime when an ODL carrier was available, on their NS day, to work the overtime.

10. Step B decision Art. 8.5.G, Br. 2611 Silver Spring, MD, July 2011.

11. Step B decision.  Local union awarded $1000.00 when management refuses to provide requested information, Wheaton, Maryland, 2007.

12. Arbitration out of Charleston, SC concerning Art. 8 violations and the use of escalating remedies as part of the settlement.

13. Arbitration, USPS ordered to pay local union $300.00 for failing to meet at Formal A.

14. Branch 6000 information about their grievance filed concerning the management's implementation of a total of 18 MSP scan points.

15.  Supreme court decision concerning the selection of union representatives in PDI and disciplinary cases.
