1. 53-2003-DL102. Step B. Letter of Warning for delivering express mail at 12:13 missing the noon deadline for the first time in his 16 year career is reduced to a discussion.

2. 53-2003-MS072. PRE-ARBITRATION. Letter of Warning alleging a failure to report an accident immediately is reduced to a discussion.

3. 53-2003-DL98. Step B. Letter of Warning for getting injured (broken finger) is reduced to a discussion. (Grievant did not violate a rule or regulation.)

4. 53-2003-DL99. PRE-ARBITRATION. Letter of Warning alleging a failure to report an accident immediately is reduced to a discussion.

5. 51-2003-DL31. PRE-ARBITRATION. Management will cease and desist moving carriers off opts (holddowns). Grievant is hereby paid a lump-sum of $250.00

6. 53-2003-DL28. PRE-ARBITRATION. Management accepted some of the Grievant's FMLA request and denied some resulting in AWOL charges. Grievant was issued a Letter of Demand for the portion of the leave paid. Resolved; The leave is hereby changed to FMLA sick leave (paid $4,350.00) and the Letter of Demand is rescinded. Grievant is cautioned to submit 3971's in a timely manner and indicate leave preference.

7. 53-2003-DL113. Informal A. Letter of Warning alleging poor attendance is reduced to 6 months in OPF.

8. 53-2004-DL8. Step B. Letter of Warning for being involved in a vehicle accident in the rain is reduced to 6 months in OPF.

9. 53-2003-MS027. Formal A. Management demanded that the Grievant sign an E-Travel form. We agreed to withdraw the case when management backed down and agreed that we don't have to sign an E-Travel form to be reimbursed for travel.

10. 53-2003-DL105. Formal A. Management ordered the Carrier to clock back on after clocking out for the day and carry auxiliary assistance without paying the Grievant his 4 hour guarantee. Resolved; Grievant will be paid an additional 2.57 hours of penalty pay.

11. 53-2003-DL110. Informal A. Grievant was ordered to work 7.24 hours on his nonscheduled day to avoid working over 60 hours for the week, but failed to pay the Grievant his 8 hour guarantee. Resolved; Grievant will be paid an additional 76 units at the overtime rate.

12. 53-2003-DL111. Formal A. The following full-time regular carriers will be paid an additional 50% for all hours over 12, the maximum in a day. 12.27 hours, 13.19 hours, 13.16 hours, 12.53 hours, 12.97 hours and 12.30 hours. The following PTF's will be paid an additional 50% for all hours over 11 and 1/2, the maximum in a day. (12.48 hours and 12.22 hours.)

13. 53-2003-DL109. Formal A. The following carriers will be paid an additional 50% for all hours over 60 for the week plus an additional $25.00 each as an escalating remedy due to numerous prior settlements (60.36 hours, 60.26 hours and 60.30 hours.)

14. 53-2003-DL112. Informal A. Grievant will be paid an additional 100%, as an escalating remedy, for the 9.97 hours he was forced to work on his designated holiday without all the PTF's and casuals working 12 clock hours.

15. 53-2003-DL113. Formal A. The following carriers will be paid an additional 50% for all hours over 60 for the week plus an additional $25.00 each as an escalating remedy due to numerous prior settlements (61.41 hours, 60.86 hours, 60.48 hours, 60.13 hours and 60.25 hours.)

16. 53-2003-DL101. Formal A. The FMLA request would have been approved if it were not for incomplete documentation.

17. 53-2003-DL104. Formal A. The following full-time regular carrier will be paid an additional 50% for all hours over 12, the maximum in a day plus $25.00 as an escalating remedy due to repeat violations (12.22 hours.)

18. 53-2003-DL103. Formal A. Due to a violation of Article 8 Section 5G (overtime rules) the following four NON-ODL's will be paid an additional 75% (double time and a quarter) as stated; 1.25 hours, 1.00 hour, 1.25 hours and 1.25 hours. The following four ODL's will be paid as stated; 11 units of overtime and 89 units of penalty pay, 1 unit of overtime and 1.24 hours of penalty pay, 1.25 hours of penalty pay, .15 hours of overtime and 1.10 hours of penalty pay.

19. 53-2004-DL2. Formal A. Due to a violation of Article 8 Section 5G (overtime rules) the following four NON-ODL's will receive Administrative Leave of 8.00 hours, 8.00 hours, 8.00 hours and 5.00 hours. The following ODL's will be paid as stated; 1.50 hours of overtime, 1.18 hours of overtime, 1.15 hours of overtime, 2.39 hours of overtime, 1.76 hours of overtime, 1.99 hours of overtime, 1.12 hours of overtime, 2.42 hours of overtime, 3.05 hours of overtime, 2.27 hours of overtime, 1.47 hours of overtime, 2.37 hours of overtime, 3.21 hours of overtime and 3.18 hours overtime. (All at the overtime rate because this violation occurred in December.)

20. 53-2004-DL3. Formal A. Due to a violation of Article 8 Section 5G (overtime rules) the following NON-ODL will receive Administrative Leave of 8.00 hours. The following ODL's will be paid as stated; 1.00 hour of overtime, 1.00 hour of overtime, .50 hours of overtime, .50 hours of overtime, 1.00 hour of overtime, 1.00 hour of overtime, 1.00 hour of overtime, 1.00 hour of overtime, .50 hours of overtime, .50 hours of overtime. (All at the overtime rate because this violation occurred in December.)

21. 51-2003-DL107. Formal A. Employees who are injured on the job and are out of work due to a serious health condition may be designated FMLA for their absence by management.

22. 53-2004-DL7. Formal A. Grievant will be paid Grade 6 Level 2 for the week in question when he filled a higher level (T-6) vacancy.

23. 51-2003-DL108. Formal A. Employees who are injured on the job and are out of work due to a serious health condition may be designated FMLA for their absence by management.

24. 53-2004-DL1. Formal A. Grievant will receive 8 hours of Administrative Leave due to a violation of the holiday pecking order.
