13. 50-2004-CK58. Formal A. Management changed the days off of an injured employee from rotating to Sunday and Thursday in violation of the ELM Sections 546.141 and 546.142. Grievance is sustained.

14. 50-2004-SL107. Formal A. Grievant (a PTF) is hereby paid a lump-sum of $100.00 for being moved off his opt for two days.

15. 50-2004-CK56. Step B. Management ordered the Grievant to sign a modified job offer on the spot. The FECA states that these job offers must be taken to the employees physician for concurrence as does the Harnest/Hogan agreement. Resolved; Grievant will be provided 8 hours to take the modified job offer to their physician for concurrence and future violations will result in monetary settlements.

21. 50-2005-SL09. Formal A. 14 DAY SUSPENSION alleging unacceptable attendance when management denied the Grievant's FMLA requests. Grievant resigned from the Post Office.

23. 50-2004-SL108. PRE-ARBITRATION. Letter of Warning alleging a failure to deliver express mail by noon is rescinded as time served (3 months and 2 weeks).

24. 50-2005-CK18. Formal A. 7 DAY SUSPENSION for having an at-fault vehicle accident is hereby reduced to a Letter of Warning and further reduced from two years to one year in OPF.

25. 50-2005-CK15. Formal A. Letter of Warning alleging that the Grievant curtailed dated mail past the requested delivery date is hereby reduced to 6 months in OPF.

29. 50-2005-CK24. Formal A. Letter Carriers will not be instructed to sign for stamps by mail. However, stamps by fax that require a monetary payment will be treated as, and signed for as, an accountable item.

30. 50-2005-CK21. Formal A. This was a dignity and respect grievance.

31. 50-2005-SL19. Formal A. Due to a holiday pecking order violation, the full-time regular forced to work their designated holiday is hereby paid an additional 125% for 8 hours (an escalating remedy due to repeat violations) and the employee who should have worked is hereby paid 8 hours of straight time.

32. 50-2005-SL18. Formal A. Three NON-ODL's were forced to work a total of 2.65 hours of overtime. They will be paid an additional 125% for 2.65 hours ($61.71 per hour). Five ODL's will be paid a total of 2.65 hours at their overtime rates.

33. 50-2005-SL16. Formal A. The NON-ODL who was forced to work 1.15 hours of overtime is hereby paid an additional 125% for 1.15 hours ($61.71 per hour) and the ODL who was available to provide the assistance to that NON-ODL is hereby paid 1.15 hours of overtime.

34. 50-2005-CK8. Formal A. NON-ODL'S were forced to work overtime. From this point forward, a note will be posted on the time clock indicating that maximization will occur. Some ODL'S left due to emergencies, some left on their own volition, some were not utilized because they started at 10:00am and some PTF'S were not utilized because they started at 10:00am.

35. 50-2005-CK19. Informal A. The 204b will cease and desist casing mail and will not do any craft work from this point forward.

36. 50-2005-CK10. Formal A. Five NON-ODLíS were forced to work a total of 7.65 hours of overtime. They will be paid an additional 125% for those 7.65 hours ($61.71 per hour). The PTF who was sent home (management alleged there was no work to do) is hereby paid 7.65 hours of straight pay.

37. 50-2005-CK16. Formal A. This is a dignity and respect grievance. Management acted inappropriately during an Accident Repeater Meeting. Resolved; The purpose of the Accident Repeater Meetings is to find the root cause of the accident in an effort to avoid others from having the same or similar fate. If a question or comment deviates from the stated purpose of these Accident Repeater Meetings, the Union representative present will be allowed to object. Management agrees to stick to the stated purpose of the Accident Repeater Meetings.

38. 50-2004-CK60. Formal A. Management agrees that they will cease and desist holding a carriers last paycheck when they retire awaiting the carriers postal photo badge and the uniform credit card if management fails to inform the carrier that these items must be turned in to management.

39. 50-2005-SL17. Formal A. The NON-ODL who was forced to work .86 hours of overtime is hereby paid an additional 125% for .86 hours ($61.71 per hour) and the ODL who was available to provide the assistance to that NON-ODL is hereby paid .86 hours of overtime.

40. 50-2005-SL07. Step B. Management refused to inspect auxiliary route 050057. Resolved; Route 050057 will be inspected within 52 days.

41. 50-2005-SL06. Step B. Management refused to inspect auxiliary route 050051. Resolved; Route 050051 will be inspected within 52 days.

42. 50-2005-SL08. Step B. Management refused to inspect auxiliary route 050058. Resolved; Route 050058 will be inspected within 52 days.

43. 50-2005-CK9. Formal A. Management refused to pay this PTF 8 hours of sick leave on Saturday. Management approved the 3971, but later in the workweek took the position that they had the absolute right to change their mind and not pay sick leave. Resolved; Management will pay the 8 hours of sick leave and adjust the Grievantís pay for the week by paying overtime for all hours over 40 and double time for all hours over 56.

44. 50-2005-SL02. Formal A. Grievant called in sick before a holiday so management decided they would AWOL this employee. Resolved; The AWOL charge is hereby changed to paid sick leave.

45. 50-2005-SL10. Formal A. The Union arbitration advocate provided the Station Manager with the witnesses for an arbitration and asked this Station Manager to call the other Station Managers to ensure that the witnesses would be present and on time at the arbitration hearing. This was not done. Resolved; From this point forward, the Union arbitration advocate will notify the OIC/Postmaster of Rockville, MD and they will contact the appropriate Station Managers to ensure that the Union witnesses will be at the arbitrations. Adequate time to drive to the arbitration site will be afforded in an effort to make sure the witnesses are on time.

50. 50-2005-CK23. Formal A. Management refused to allow the cage clerk to clear this carrier. Resolved; The customer will be sent a letter requesting payment for a C.O.D. and express mail piece.

51. 50-2005-SL11. Formal A. A 204b went back to her assignment for three days to avoid having the assignment put up for bid. Resolved; Management will cease and desist circumventing this part of the contract (Article 41 Section 1A2).

54. 50-2004-CK59. Formal A. A 10 hour preference ODL was assigned work for 11.23 hours while a 12 hour preference ODL was told to get off the clock at 10 hours of work. Resolved; The 12 hour preference ODL is hereby paid 1.23 hours of double time. Also, a full-time regular did not receive his 4 hour guarantee after clocking out and then being given 1.38 hours of additional work. Resolved; This carrier is hereby paid an additional 2.62 hours of double time.
