1. 50-2003-DP16. Formal A. Letter of Warning for getting injured on the job is hereby rescinded (Grievant did not violate any rule or regulation.)

2. 50-2003-DP14. Formal A. Letter of Warning alleging AWOL for the entire day is hereby reduced to a discussion. (One of the supervisors told her she could have the day off).

3. 50-2003-CK26. Formal A. Letter of Warning alleging unauthorized overtime is rescinded (Grievant was issued the exact same discipline 30 days prior, thus, double jeopardy was the defense.)

4. 50-2003-SL141. Formal A. 7 DAY SUSPENSION alleging unsafe driving practices is reduced to a Letter of Warning and further reduced from 24 months to 9 months in OPF.

5. 50-2004-SL03. Informal A. Letter of Warning for being caught using a cell phone on the route is reduced to 9 months in OPF.

6. 50-2003-CK29. Step B. 7 DAY SUSPENSION alleging a week of AWOL is reduced to 6 months in OPF.

7. 50-2003-CK23. Formal A. Grievant will be able to listen to her radio that is built into her cell phone earpiece in the office.

8. 50-2003-SL143. Formal A. Grievant's clockrings were altered shorting his pay. Resolved; Grievant is hereby paid an additional 49 units of Holiday worked pay.

9. 50-2003-DP17. Formal A. The 8 hours of AWOL is hereby changed to 8 hours of LWOP.

10. 50-2004-SL01. Informal A. Management unreasonably denied the Shop Steward time to review a grievance forcing the Steward to prepare the case off the clock. Resolved; The Steward will be paid 75 units at her straight time rate.

11. 50-2004-SL02. Formal A. Management refused to hear a grievance at Informal A. Resolved; The grievance is withdrawn with the understanding that the Station Manager will meet with all the supervisors in the building and inform them of their contractual mandate to meet with the Union at Informal A.

12. 50-2004-CK1. Formal A. Letter of Warning alleging a failure to lock the vehicle on the route with mail inside is rescinded without considering the merits of the case due to management failing to provide the information requested by the Union.

13. 50-2004-SL08. Informal A. When forcing NON-ODL's to work their N/S day, management will ask for volunteers and put it on the schedule as soon as possible.

14. 50-2004-SL11. Step B. 14 DAY SUSPENSION for tripping on equipment left on the dock while exiting the building and breaking his ankle is reduced to a discussion. Grievant did not violate a rule or regulation.

15. 50-2004-SL25. Formal A. 7 DAY SUSPENSION alleging hit and run of a basketball hoop on a mounted route is reduced to a Letter of Warning and further reduced to one year in OPF.

16. 50-2004-SL24. Informal A. Letter of Warning for not coming to work on N/S day even though the Grievant notified management he could not work that day is reduced to a discussion.

17. 50-2004-SL26. Informal A. Letter of Warning for falling down on his route even though there was not a claim filed is rescinded.

18. 50-2004-SL16. Formal A. Three NON-ODL's were forced to work overtime in violation of Article 8. Thirteen ODL's will split 24.34 hours (mostly penalty pay) and the NON-ODL's will be paid an additional 125% for the hours they worked as an escalating remedy due to hundreds of prior settlements.

19. 50-2004-CK11. Formal A. Grievant was charged AWOL for leaving work to get an injection in her ankle as the result of an on the job injury. Resolved; The AWOL hours are changed to LWOP which can be claimed with the Department of Labor.

20. 50-2004-CK2. Formal A. Four NON-ODL's worked over 8 hours on their N/S day. They will be paid an additional 25% for all hours over 8 (8.89 hours, 8.81 hours, 9.04 hours and 9.75 hours) even though all the ODL's worked 12 hours that day (Article 8.5F).

21. 50-2004-SL07. Formal A. Information was unreasonably delayed to the Union for a possible grievance. Resolved; Grievance was withdrawn with the promise that these types of violations by management will cease and since the filing of this grievance the OIC has made significant improvements concerning the Union receiving information in a timely manner.

22. 50-2004-CK3. Formal A. Grievant, a NON-ODL, was required to work overtime on 5 regularly scheduled days in a workweek in violation of Article 5F of the National Agreement. Therefore, the Grievant will be paid an additional 50% for all hours worked over 8 on this day (9.99 hours). Since the Grievant was already receiving double time this would mean double time and 1/2 or about 50 dollars per hour!

23. 50-2004-SL15. Informal A. The following carriers will be paid an additional 50% for all hours over 60 in a week, the supposed maximum. (62.00 hours, 60.71 hours, 60.75 hours, 61.51 hours, 60.81 hours, 61.67 hours and 60.50 hours.)

24. 50-2004-SL13. Informal A. The following carriers will be paid an additional 50% for all hours over 12 in a day, the supposed maximum. (12.95 hours and 12.90 hours.)

25. 50-2004-SL14. Informal A. The following PTF carriers will be paid an additional 50% for all hours over 11 and 1/2 in a day, the supposed maximum. (12.50 hours, 12.90 hours and 12.60 hours.)

26. 50-2004-SL18 Informal A. The following carrier will be paid an additional 50% for all hours over 12 in a day, the supposed maximum. (12.49 hours). Also, the same carrier will be paid one hour at the penalty rate for being ordered to clock back on after clocking out for the day.

27. 50-2004-SL36. Informal A. Grievant, a NON-ODL, will be paid an additional 125% for the 69 units of mandatory overtime in violation of Article 8 and the ODL cited by the Union will receive 69 units of overtime.

28. 50-2004-SL37. Informal A. The unauthorized overtime notation of 1.03 hours on the 1017-B log is removed. (The Grievant called back and was instructed to keep delivering the mail.)

29. 50-2004-SL38. Informal A. Management will cease and desist pre-determining the amount of time the Grievant will be allowed to see her Shop Steward.

30. 50-2004-SL40. Informal A. Management will cease and desist violating Article 34 of the National Agreement and using DOIS (computer estimate) to determine the amount of hours authorized to case and carry the route.

31. 50-2004-SL41. Informal A. Management will cease and desist pre-determining the amount of time the Grievant will be allowed to see her Shop Steward.

32. 50-2004-SL42. Informal A. Grievant, a NON-ODL, will be paid an additional 125% for the 71 units of mandatory overtime in violation of Article 8 and the ODL cited by the Union will receive 71 units of overtime.

33. 50-2004-SL12. Formal A. The 8 hours of AOT (absent from overtime) charged to the Grievant is rescinded.

34. 50-2004-SL28. Informal A. The unauthorized overtime notation of 96 units on the 1017-B log is removed. (The Grievant called back and was instructed to keep delivering the mail.)

35. 50-2004-SL29. Informal A. Management will cease and desist violating Article 34 of the National Agreement and using DOIS (computer estimate) to determine the amount of hours authorized to case and carry the route.

36. 50-2004-SL32. Informal A. Grievant, a NON-ODL, will be paid an additional 125% for the 96 units of mandatory overtime in violation of Article 8 and the ODL cited by the Union will receive 96 units of overtime.

37. 50-2004-SL30. Informal A. Management will cease and desist violating Article 34 of the National Agreement and using DOIS (computer estimate) to determine the amount of hours authorized to case and carry the route.

38. 50-2004-SL34. Informal A. The unauthorized overtime notation of 69 units on the 1017-B log is removed. (The Grievant called back and was instructed to keep delivering the mail.)

39. 50-2004-SL35. Informal A. Management agreed to treat the Grievant with dignity and respect so the Grievant asked to withdraw the grievance.

40. 50-2004-SL10. Informal A. Grievant, a NON-ODL, will be paid an additional 125% (double time and 3/4 or about $55 per hour) for the 1.04 hours of mandatory overtime in violation of Article 8 and the ODL cited by the Union will receive 1.04 hours of overtime.

41. 50-2004-SL33. Informal A. Management will cease and desist violating Article 34 of the National Agreement and using DOIS (computer estimate) to determine the amount of hours authorized to case and carry the route.

42. 50-2004-CK7. Formal A. From this point forward, Grievant will receive a CA-17 upon request.

43. 50-2004-SL27. Informal A. Grievant, a NON-ODL, will be paid an additional 125% (double time and 3/4 or about $55 per hour) for the 1.38 hours of mandatory overtime in violation of Article 8 and the ODLís cited by the Union will receive 1.38 hours of overtime (50 units, 50 units and 38 units.)

44. 50-2004-SL39. Informal A. Grievant, a NON-ODL, will be paid an additional 125% (double time and 3/4 or about $55 per hour) for the 1.03 hours of mandatory overtime in violation of Article 8 and the ODLís cited by the Union will receive 1.03 hours of overtime (50 units and 53 units.)

45. 50-2004-SL31. Informal A. Grievant called back to ask for instructions when unable to complete the assignment in the allotted time. The supervisor told her to ďdo what your were told in the morning.Ē This violates numerous local settlements and agreements. The only thing management is allowed to say is; deliver the mail or bring it back. Resolved; Supervisor apologized and agreed to comply with the above.

46. 50-2004-SL23. Informal A. The following 5 PTF carriers will be paid an additional 50% for all hours over 11 and 1/2 in a day, the supposed maximum. (12.00 hours, 12.81 hours, 12.00 hours, 12.00 hours and 11.80 hours.)

47. 50-2004-SL20. Informal A. Three NON-ODLís were each forced to work one hour of overtime in violation of Article 8. They will be paid an additional 50% for the three hours. Three ODLís selected by the Union will be paid 3 hours of penalty pay.

48. 50-2004-SL43. Informal A. Grievant will be treated with dignity and respect and will not be singled out.

49. 50-2004-CK8. Formal A. From this point forward, Grievant will receive a CA-17 upon request.

50. 50-2004-SL22. Informal A. The following carriers will be paid an additional 50% for all hours over 60 in a week, the supposed maximum. (62.60 hours, 60.35 hours, 62.79 hours, 60.87 hours, 63.41 hours, 65.81 hours and 60.64 hours.)

51. 50-2004-SL04. Formal A. Management delayed Grievant access to a Shop Steward. Withdrawn with the understanding that management will cease and desist violating the agreement made concerning access to stewards. That is; All Union time will be granted immediately unless all ODLís are working 12 hours and all NON-ODLís are working 10 hours.

52. 50-2004-SL05. Formal A. Management ordered the Grievant to submit documentation for a sick call and then was rude and hung up on the Grievant. Resolved; Grievant will be treated with dignity and respect and will be reimbursed for the physicianís fee.

53. 50-2004-CK6. Grievantís absences will be changed from sick leave to FMLA sick leave.

54. 50-2004-SL09. Formal A. Management delayed Grievant access to a Shop Steward. Withdrawn with the understanding that management will cease and desist violating the agreement made concerning access to stewards. That is; All Union time will be granted immediately unless all ODLís are working 12 hours and all NON-ODLís are working 10 hours.

55. 50-2004-CK5. Formal A. Two NON-ODL's worked over 8 hours on their N/S day. They will be paid an additional 25% for all hours over 8 (10.00 hours, and 8.72 hours) This is a violation of Article 8.5F.

Also, all the ODLís will be paid 12 hours (14.44 hours of penalty pay) and all the PTFís will be paid 10 hours.
